Cargo

Cargo can be carried in the hold of Loganair’s aircraft on the scheduled network, subject to load availability. Cargo must be pre-booked, and every effort will be made to carry it on the first available flight. Perishable goods should only be presented with prior arrangement.

All freight consignments should be presented to Loganair’s handling agent at the departure airport and collected from the arrival airport. Freight can be transferred to another carrier for onward transportation. The following commodities require advance arrangements:

  • Valuable cargo
  • Perishables
  • Freight requiring special care
  • Dangerous goods

Cargo rates for British Airways flights operated by Loganair (BA flight range BA4000-4129) can be found here.

The Gael Express rate is all-inclusive, covering the Airway Bill fee and VAT. It applies to goods weighing less than 5kg from the islands, but not from the mainland. Payment must be made by cash or cheque. A separate security levy may apply.

Minimum and kilo rates exclude the Airway Bill fee (£3.00), any security levy, and VAT at 20%.

For Orkney Internal freight, there is no Airway Bill fee. If an invoice is required, a minimum charge of £15 plus VAT (£18.00) applies.

Liability

Loganair’s legal liability for the carriage of cargo is governed by the Conditions of Contract-Cargo, which are outlined on the reverse of the shipping documentation, known as the Air Waybill.

For a full understanding of the terms, please refer to the extract from the Conditions of Contract provided below.

Conditions of Carriage

Notice

  • If the carriage involves an ultimate destination or stop in a country other than the country of departure, the Warsaw Convention may apply, which governs and limits the carrier's liability for loss or damage to cargo.

Definitions

  1. Carrier: Refers to all carriers that undertake to carry the consignment or perform any incidental services.
  2. Warsaw Convention: Refers to the Convention for the Unification of rules relating to international carriage by air (signed at Warsaw, 1929) or its amended version at The Hague (1955), depending on the carriage type.
  3. Carriage: Subject to applicable laws, government regulations, tariffs, and conditions of carriage.

Limitations of Liability

  1. Liability Limit: Carrier's liability is limited to $20 (or equivalent) per kilogram for loss, damage, or delay. The actual weight of the damaged or delayed package is considered for claims.
    • Exclusions or limitations of liability also apply to the carrier's agents, representatives, and anyone involved in the aircraft’s operation.

Carriages and Expenses

  1. Substitution: Carrier can substitute other carriers or aircraft without prior notice, ensuring the shipper’s interests are considered.
  2. Charges: The consignment charge does not include customs duties or taxes. The shipper and consignee are jointly liable for such charges.
  3. Consignment Handling: If the consignee refuses delivery or the address is incorrect, the consignment will be handled according to the carrier’s conditions.

Notice of Claims and Time Limitations

  1. Claims:
    • Damage to Goods: Written notice must be submitted within 14 days from receipt.
    • Delay: Written notice must be submitted within 21 days from the date the consignment is available for delivery.
    • Loss: Written notice must be submitted within 120 days from the Air consignment note issue date.
    • Time Limits for Damages: Actions for damages must be filed within two years from arrival, scheduled arrival, or cessation of transportation.

Compliance with Laws and Regulations

  1. Shipper’s Responsibility: The shipper must comply with all applicable laws, customs, and government regulations for the consignment's packaging, carriage, and delivery. Non-compliance is not the carrier’s responsibility.

Agents

  1. Agency: The carrier is an agent for issuing the consignment note for other carriers’ routes.
  2. No Authority: Carrier’s agents have no authority to alter or waive contract terms.

Security

  1. Inspection: The carrier reserves the right to open and inspect any consignment for security screening purposes.

These conditions set clear guidelines for the transport of cargo, its liability, and claim processes.
